  1.         我們如何蒐集和利用您的個人資料

我們僅會出於本隱私政策所述的以下目的,遵循合法、正當、必要的原則,蒐集、處理和利用遊戲功能所必要的您的個人資料:

1.1       遊戲登錄

當您登錄遊戲時,我們會蒐集您的登錄設備資訊,包括但不限於IMEI號碼、Mac位址或Openudid用於標記或驗證您的遊戲用戶身份。

您登錄遊戲後我們鼓勵您綁定Facebook/Apple/Google Play帳戶,以使用此帳戶在多臺設備上玩遊戲保護您的遊戲進度。這些綁定、關聯和補充提供的個人資料由您主動提供,會增加您帳號的安全性並便利您在更換設備繼續遊戲進程。如您拒絕提供,並不會影響您享受遊戲服務。

1.2       消費和交易

如您選擇遊戲中的消費和交易服務:

1.2.1   如您以新臺幣購買虛擬貨幣,我們會蒐集您的值紀錄資訊,以便您查詢您的交易紀錄。

1.2.2   對於您在遊戲內有關虛擬資產的消費和交易,我們會保留您的消費和交易紀錄,同時盡最大程度保護您的虛擬資產的安全。

1.3       遊戲社交

1.3.1   遊戲中您可以使用添加好友的社交功能。使用這些服務時,您的個人資料(如匿稱、頭像照片等)將會被查詢或公開。,您也可以在遊戲中或遊戲論壇進行文字、圖片、音視頻形式的資訊發佈,請您注意在資訊發佈時謹慎披露涉及個人的隱私性或敏感性資訊。您的通信內容和發佈內容將授權我們出於資訊內容安全的目的進行存儲和審查。

1.4       客戶服務

為了向您提供遊戲服務,我們客服人員以及遊戲中的熱心用戶擔任的遊戲MOD將使用您主動提供的電子郵件位址、手機號碼、Line帳號等方式與您聯繫。同時,為了核實您的身份以及解決您的客戶服務需求,我們可能還需要您提供遊戲帳號、身份證資訊、消費紀錄等。

1.5       提供遊戲服務

當您登錄帳號開始遊戲時,我們將蒐集您的遊戲操作資訊,包括登錄日誌、物品日誌、遊戲對局資訊、交紀錄、消費紀錄等,以便您能夠在用戶端查看您的遊戲歷史紀錄,同時,我們也會使用這些遊戲操作資訊用於遊戲運營統計分析、客服投訴處理及其他遊戲安全分析。

我們可能隨時在遊戲內或遊戲外(例如粉絲頁)發起一系列活動,例如用戶滿意度調查、用戶體驗計畫、邀請參加測試、參與競賽報名或促銷活動等,您可以根據意願自主決定參與並按照我們要求提供個人資料,包括但不限於年齡、性別、聯繫地址、職業、教育背景等。

1.6       安全保障及改善產品或服務。

為保障您正常使用我們的服務,維護遊戲基礎功能的正常運行,優化遊戲產品性能,提升您的遊戲體驗並保障您的帳號安全,打擊破壞遊戲公平環境或干擾、破壞遊戲服務正常進行的行為,我們將蒐集您在使用本服務時的設備資訊或個人行為資訊,包括:

1.6.1   設備的軟硬體資訊以及您通過開啟的設備設置允許我們接收的資訊,例如,設備型號、作業系統版本、設備識別字(如IDFAIDFV)等資訊;軟體的版本號、瀏覽器類型。

1.6.2   設備連接和網路狀態資訊,如使用的語言或IP位址。

1.6.3   服務日誌資訊。我們會記錄您使用我們產品的時間和上一次使用時間,以及您在我們的產品中查看和停留資訊,遊戲進程及遊戲崩潰紀錄,以便我們優化產品和服務。

1.7       設備許可權

我們在遊戲安裝時不會向您獲取任何設備許可權,在遊戲使用過程中,如果需要某些設備許可權,我們向您說明用途並取得您的同意,您開啟這些許可權即代表您授權我們可以蒐集和利用這些資訊來實現相應功能。包括:我們需要獲得您的設備讀寫存儲許可權以便存儲圖片檔;讀取您的本機號碼和設備ID,以保證帳號登錄的安全性,但我們不會讀取您的通話狀態或撥打其他號碼或終止通話;獲得您的地理位置資訊在遊戲中的社交功能展現您所在的城市;獲得麥克風和攝像頭許可權以便開啟語音聊天、直播互動、視頻錄製等功能;我們如需在應用內安裝其他應用亦會獲得您的同意。您可以通過設備設置取消部分授權,我們則無法為您提供上述與這些授權所對應的功能。

1.8       其他

1.8.1   鑒於我們向您提供的功能和服務是不斷更新和發展的,如果某一功能或服務未在前述說明中且蒐集了您的資訊,我們會通過頁面提示、交互流程等方式另行向您說明資訊蒐集的內容、範圍和目的,以獲得您的同意。

1.8.2   但是,根據相關法律法規及國家標準,以下情形中,我們可能會蒐集、處理的相關個人資料無需徵求您的授權同意:

a)           法律明文規定

b)           與您有契約或類似契約之關係,且已採取適當之安全措施;

c)           所收集的個人資訊是您自行向社會公眾公開的;

d)           學術研究機構基於公共利益為統計或學術研究而有必要,且資料經過提供者處理後或經蒐集者依其披露方式無從識別特定之當事人

e)           經您同意

f)             為增進公共利益所必要。

g)           個人資料取自於一般可得之來源。

  1.         我們如何使用 Cookie 和同類技術
    1.    Cookie

為確保網站正常運轉,我們會在您的電腦或行動設備上存儲名為 Cookie 的小資料檔案。Cookie 通常包含識別字、網站名稱以及一些號碼和字元。我們借助於 Cookie,可能用於記住您的身份,分析您使用我們服務的情況,根據您的行為偏好為您提供廣告優化等。

    1.    共用

我們不會與台灣智娛以外的任何公司、組織和個人分享您的個人資料,但以下情況除外:

3.1.1   在獲取明確同意的情況下共用:獲得您的明確同意後,我們會與其他方共用您的個人資料。

3.1.2   我們可能會根據法令規定,或按政府主管機關的強制性要求,對外共用您的個人資料。

3.1.3   與我們的關係企業共用:您的個人資料可能會與台灣智娛的關係企業共用。我們只會共用必要的個人資料,且受本隱私政策中所聲明目的的約束。關係企業如要改變個人資料的處理目的,將再次徵求您的授權同意。

3.1.4   與授權合作夥伴共用:僅為實現本隱私政策中聲明的目的,我們的某些服務將由授權合作夥伴提供。我們可能會與合作夥伴共用您的某些個人資料,以提供更好的客戶服務和使用者體驗。目前,我們的授權合作夥伴包括以下類型:

a)           廣告、分析服務類的授權合作夥伴。我們會基於合法蒐集的個人資料,授權協力廠商廣告或分析類服務夥伴,通過資訊系統、演算法等非人工自動決策技術實現標籤化或畫像處理,從而做出的自動決策決定(如商業化資訊推送),如果您不希望參與此類定向廣告資訊推送,請通過第九部分的聯繫方式要求我們作出解釋,我們也將提供適當的救濟方式。

b)           供應商、服務提供者和其他合作夥伴。我們將資訊發送給在全球範圍內支持我們業務的供應商、服務提供者和其他合作夥伴,這些支援包括提供技術基礎設施服務、分析我們服務的使用方式、衡量廣告和服務的有效性、提供客戶服務、支付便利或進行學術研究和調查。例如:為我們提供國內提供資訊分發以及緩存服務以及國際伺服器租用服務的供應商。我們鼓勵您通過在FacebookTwitterYouTubeVK平臺透過點讚或訂閱的形式支持我們的遊戲,如果您進行點讚或訂閱,您的基本帳戶資訊將與這些平臺共用。我們將於提供支付管道和功能的ApplePay共用您的交易資訊。

c)           其他接入協力廠商服務的情形。例如,為實現本隱私政策中聲明的目的,我們可能會接入協力廠商SDK服務,並將我們依照本隱私政策蒐集您的某些個人資料共用給該等協力廠商,以便提供更好的客戶服務和使用者體驗。該等協力廠商服務由相關的協力廠商負責運營。您使用該等協力廠商服務(包括您向該等協力廠商提供的任何資訊),須受協力廠商服務條款及隱私政策約束,您需要仔細閱讀其條款。本隱私政策僅適用於我們所蒐集的個人資料,並不適用於任何協力廠商提供的服務或協力廠商的資訊使用規則。如您發現這些協力廠商服務存在風險時,建議您終止相關操作以保護您的合法權益。

對我們與之共用個人資料的公司、組織和個人,我們會與其簽署嚴格的保密協定,要求他們按照我們的說明、本隱私政策以及其他任何相關的保密和安全措施來處理個人資料。

3.2       轉讓

我們不會將您的個人資料轉讓給任何公司、組織和個人,但以下情況除外:

3.2.1   在獲取明確同意的情況下轉讓:獲得您的明確同意後,我們會向其他方轉讓您的個人資料;

3.2.2   在涉及合併、收購或破產清算時,如涉及到個人資料轉讓,我們會在要求新的持有您個人資料的公司、組織繼續受此隱私政策的約束,否則我們將要求該公司、組織重新向您徵求授權同意。

3.3       公開披露

我們僅會在以下情況下,公開披露您的個人資料:

3.3.1   獲得您明確同意後;

3.3.2   基於法律的披露:在法律、法律程式、訴訟或政府主管部門強制性要求的情況下,我們可能會公開披露您的個人資料。

  1.         我們如何保護您的個人資料
    1.    我們已使用符合業界標準的安全防護措施保護您提供的個人資料,防止資料遭到未經授權訪問、公開披露、使用、修改、損壞或丟失。我們會採取一切合理可行的措施,保護您的個人資料。例如,在您的設備與伺服器之間交換資料(如信用卡資訊)時受 SSL 加密保護;我們同時會使用加密技術確保資料的保密性;我們會使用受信賴的保護機制防止資料遭到惡意攻擊;我們會部署存取控制機制,確保只有授權人員才可訪問個人資料;我們會瞭解和分析您設備安裝的應用資訊和運行的進程資訊,以預防病毒、木馬等惡意程式。
    2.    我們的資料安全能力:我們構建強大的資料安全保護體系,包括對使用者資訊進行識別、加密保存、資料存取權限劃分;制定內部資料管理制度和操作規程,從資料的獲取、使用、銷毀都有嚴格的流程要求,避免使用者隱私資料被非法使用;確定接觸使用者個人資料的各部門及其負責人安全管理責任;建立使用者個人資料蒐集、利用及其相關活動的工作流程和安全管理制度; 對工作人員及代理人實行許可權管理,對批量匯出、複製、銷毀個人資料實行審查,並採取防洩密措施;妥善保管記錄使用者個人資料的紙介質、光介質、電磁介質等載體,並採取相應的安全儲存措施;對儲存使用者個人資料的資訊系統實行接入審查,並採取防入侵、防病毒等措施;定期對員工開展個人資料保護的相關培訓。
    3.    我們會採取一切合理可行的措施,確保未蒐集無關的個人資料。我們只會在本隱私政策所述目的所需的期限內保留您的個人資料,除非取得您的同意需要延長保留期或受到法律的允許。
    4.    網際網路環境並非百分之百安全,我們將盡力確保或擔保您發送給我們的任何資訊的安全性。如果我們的物理、技術、或管理防護設施遭到破壞,導致資訊被非授權訪問、公開披露、篡改、或毀壞,導致您的合法權益受損,我們將承擔相應的法律責任。
    5.    在不幸發生個人資料安全事件後,我們將按照法律法規的要求,及時向您告知:安全事件的基本情況和可能的影響、我們已採取或將要採取的處置措施、您可自主防範和降低風險的建議、對您的補救措施等。我們將及時將事件相關情況以郵件、信函、電話、推送通知等方式告知您,難以逐一告知個人資料主體時,我們會採取合理、有效的方式發佈公告。

同時,我們還將按照監管部門要求,主動上報個人資料安全事件的處置情況。

4.6       若您發現您的個人資料洩露時,請您立即通過本隱私政策約定的聯繫方式與我們聯繫,以便我們及時採取相應措施。

  1.         您的權利

我們將按照臺灣相關的法律、法規、標準,參考其他國家、地區的通行做法,我們將努力保障您對自己的個人資料行使以下權利:

5.1       訪問您的個人資料。

您可以通過「設置-帳號」查看您的個人資料。如果您無法通過前述途徑訪問個人資料,您可以隨時通過第九部分的聯繫方式聯繫我們,我們將在合理期限內回覆您的訪問請求。

5.2       更正您的個人資料。

您可以通過「設置-帳號」對您已綁定的帳號資訊及個人資料進行更改。如果您無法通過前述途徑更改個人資料,您可以隨時通過第九部分的聯繫方式聯繫我們,我們將在合理期限內回覆您的更正請求。

5.3       刪除您的個人資料。

您可以隨時通過第九部分的聯繫方式聯繫我們,向我們提出刪除個人資料的請求,特別是在以下情況發生時:

5.3.1   如果我們處理個人資料的行為違反法律法規;

5.3.2   如果我們蒐集、利用您的個人資料,卻未取得您的同意;

5.3.3   如果我們處理個人資料的行為違反了與您的約定;

5.3.4   如果您不再使用我們的產品或服務,或您登出了帳號;

5.3.5   如果我們不再為您提供產品或服務。

若我們決定響應您的刪除請求,我們還將同時通知從我們獲得您的個人資料的實體,要求其及時刪除,除非法律法規另有規定,或這些實體獲得您的獨立授權。

當您從我們的服務中刪除資訊後,我們可能不會立即備份系統中刪除相應的資訊,但會在備份更新時刪除這些資訊。

5.4       改變您授權同意的範圍。

對於額外蒐集的個人資料的蒐集和利用,您可以隨時給予或收回您的授權同意。您可以通過更改手機設備中的相機、麥克風、通訊錄等存取權限或更改瀏覽器功能設置、更改產品的設置選項,或者向我們第九部分的聯繫方式發送通知的方式改變授權同意的範圍。當您收回同意後,我們將不再處理相應的個人資料。但您收回同意的決定,不會影響此前基於您的授權而開展的個人資料處理。

5.5       個人資料主體登出帳戶

您隨時通過第九部分的聯繫方式申請登出帳戶。在註銷帳戶之後,我們將停止為您提供產品或服務,並依據您的要求,刪除您的個人資料或進行匿名化處理,法律法規另有規定的除外。

請注意,若您在登出時存在需要您履行義務的事宜,且在法律法規允許的範圍內,您的註銷申請不會被立即支持。當您確認登出成功後,帳戶資訊、個人身份證資訊、交易紀錄等將無法恢復或提供;但您仍應對您在註銷帳號前且使用平臺服務期間的行為承擔相應責任。

5.6       個人資料主體獲取個人資料副本

您有權在臺灣法律法規支持範圍內獲取我們所蒐集的您的個人資料副本,您可以透過聯繫我們索取上述資訊的副本。

在技術可行的前提下,例如資料介面匹配,我們還可按您的要求,直接將您的個人資料副本傳輸給您指定的協力廠商。

5.7       回應您的上述請求

為保障安全,您可能需要提供書面請求,或以其他方式證明您的身份。我們可能會先要求您驗證自己的身份,然後再處理您的請求。一般情況下我們將在三十天內回覆您的權利請求。如您不滿意,還可以通過第九部分的聯繫方式進行投訴。

對於您合理的請求,我們原則上不收取費用,但對多次重複、超出合理限度的請求,我們將視情收取一定成本費用。對於那些無端重複、需要過多技術手段(例如,需要開發新系統或從根本上改變現行慣例)、給他人合法權益帶來風險或者非常不切實際(例如,涉及備份磁帶上存放的資訊)的請求,我們可能會予以拒絕。

請注意,我們響應您的上述請求僅針對由我們按照本隱私政策蒐集和產生的個人資料。如果是由通路商蒐集、利用的個人資料,請您按照通路商公開的隱私政策向通路商主張您的權利。

5.8       在以下情形中,按照當地法律法規要求,我們將無法回應您的請求:

5.8.1   與國家安全、國防安全直接相關的;

5.8.2   與公共安全、公共衛生、重大公共利益直接相關的;

5.8.3   與犯罪偵查、起訴、審判和判決執行等直接相關的;

5.8.4   有充分證據表明您存在主觀惡意或濫用權利的;

5.8.5   響應您的請求將導致您或其他個人、組織的合法權益受到嚴重損害的;

5.8.6   涉及商業秘密的。

  1.         我們如何處理兒童的個人資料
    1.    我們高度重視防範未成年人沉迷遊戲以及未成年人個人資料的保護問題。我們的服務僅限20歲以上的用戶使用,如果您未滿20歲,請您立即停止使用我們的服務。我們會通過實名身份等信息校驗判斷相關帳號的實名資訊是否為完全行為能力人。
    2.    我們將統一視14周歲以下未成年人為兒童,兒童不屬於我們的用戶範圍內,我們不會蒐集和處理兒童的個人資料。
    3.    您應明確瞭解,若我們在服務過程中發現或懷疑您未滿20周歲的,則我們可以隨時中止或終止向您提供服務,直至您向我們提供您已滿20周歲的證明。如果我們發現自己在不知情的情況下蒐集兒童的個人資料,則會設法儘快刪除相關資料。
  2.         您的個人資料如何在全球範圍轉移
    1.    我們在臺灣境內蒐集和產生的個人資料將在臺灣境內存儲。
    2.    我們有可能在當地法律允許之範圍內,將您的個人註冊資訊以及在遊戲中產生的紀錄或日誌資訊(如登錄日誌、物品日誌等)等個人資料傳輸到境外伺服器。屆時,我們將遵循出境地相關法律法規的要求,確保您的個人資料得到在臺灣境內足夠同等的保護,包括但不限於履行監管部門要求的個人資料安全影響評估要求,根據要求進行備案手續,在跨境資料轉移之前實施資料去標識化等安全舉措等。
    3.    如果基於您作為個人資料主體的國籍或其他原因,需適用台灣法律之外的其他準據法管轄,我們建議您諮詢適用法國家相關專家,如無法確保您的個人資料受到您所主張的充分的保護時,請您終止使用我們的服務。
  3.         本隱私政策如何更新
    1.    請您理解,由於我們的遊戲服務不斷更新和發展,我們將努力貫徹「隱私保護設計」的理念,完善我們的產品設計,通過頁面提示、公告或交互流程等方式及時向您說明個人資料蒐集的內容、範圍和目的,作為本隱私政策的必要補充。
    2.    未經您明確同意,我們不會削減您按照本隱私政策所應享有的權利。我們會發佈對本隱私政策的更新版本。對於重大變更,我們還會提供更為顯著的通知(包括對於某些服務,我們會通過電子郵件發送通知,說明本隱私政策的具體變更內容)。
    3.    本隱私政策的重大變更包括但不限於:
      1. 我們的服務模式發生重大變化。如處理個人資料的目的、處理的個人資料類型、個人資料的使用方式等;
      2. 我們在所有權結構、組織架構等方面發生重大變化。如業務調整、破產並購等引起的所有者變更等;
      3. 個人資料共用、轉讓或公開披露的主要對象發生變化;
      4. 您參與個人資料處理方面的權利及其行使方式發生重大變化;
      5. 我們負責處理個人資料安全的責任部門、聯絡方式及投訴管道發生變化時;
      6. 個人資料安全影響評估報告表明存在高風險時。

ELEX collects information you provide directly to us via the Services, certain technical information automatically when you use our Services, and when other sources (i.e., third parties) provide it to us. A. Information You Provide To Us

There are several opportunities for you to provide or disclose personal information directly to us via the Services. The decision whether to provide the information to us belongs to you. For example, depending on the Service, you may have the option of adding a display name, profile photo, age, gender, geographic information and other details to your profile information to be displayed in the Service. 

Content you provide through our products: We collect and store content that you send, receive and share when you use the Services. This content includes any information about you that you may choose to include. Examples of content we collect and store include but are not limited to: your email address, when you choose to give it to us; the messages you post, exchange or reply in message boards, forums or chat areas, including, in certain Services, voice messages you send to your friends; information you provide in connection with a survey or contest; and any feedback you provide to us. We collect certain information automatically from and about the device(s) you utilize to access the Services and your use of the Services. C. Information We Receive From Other Sources

We receive information about you from other Service users, from third-party services, from our related companies, and from our business and channel partners.   

Other services you link to your account: We receive information about you when you integrate or link a third-party service with our Services. For example, if you log into the Services using your Google credentials, we receive your name and email address as permitted by your Google profile settings in order to authenticate you. If you log into the Services using your Facebook credentials, we receive your Facebook username, profile picture, and email address, and you will have the option to share your friends list . The information we receive when you link or integrate our Services with a third-party service depends on the settings, permissions and privacy policy controlled by that third-party service. You should always check the privacy settings and notices in these third-party services to understand what data may be disclosed to us or shared with our Services.

Other Partners: We receive information about you and your activities on and off the Services from third-party partners, such as advertising and market research partners who provide us with information about your interest in and engagement with our Services and online advertisements.

If we share your personal information with our affiliates, it is on the condition they have agreed to be bound by the terms of this Privacy Policy as it relates to their handling of your personal information.

       Application Providers.  ELEX shares your information, including personal information, with our third-party service providers, which may include agents, vendors, developers, and consultants, among others. Service providers assist us with operating the Services and provide us with other services, including marketing and promotional services. Some of these third-party service providers are necessary to provide you with the Services, perform services requested by you, and prevent and address fraud, in which case we also share information with them to fulfill our contractual obligations.

       Advertising Partners.  We may share your information, including advertising IDs, with third parties who help us market the Services, including to provide you with advertisements.

       Other Partners.  Depending on the Service, we may share your information, including personal information, with our partners in connection with offering you co-branded services, selling or distributing our products or the products of our partners, or engaging in joint marketing activities.

ELEX is not responsible for the content or the privacy policies or practices of any other websites or online services, or for the actions of the companies responsible for those websites and online services. 5.   Publicly Posted Information

Whenever you publicly post personal information online (for example on message boards, public profiles, and in chat areas), that information is stored by us and becomes publicly available, subject to the collection and use of third parties (e.g., other users). ELEX is not responsible for the subsequent use of that information by third parties. Please take caution whenever you disclose personal information in a public manner. For certain forums, you may post or reply to a post using your full first and last name with the option to also display your primary in-game character. If your personal information is posted on one of our forums, you may contact us to request removal using the information in the Contact Us section below. If we are unable to remove your personal information, we will notify you and explain the reason.

ELEX takes reasonable steps to help protect the security and integrity of any personal information you provide to us. Nevertheless, transmission via the internet is not completely secure and we cannot guarantee the security of your personal information through the Services. If we learn that your personal information has been compromised by a data breach, we will notify you consistent with applicable laws.

Please also keep in mind that you are responsible for maintaining the secrecy of your passwords and account information. Please be careful and responsible whenever you are online.

8.   Data Retention Policy

How long we keep information we collect about you depends on the type of information, as described in further detail below.  After such time, we will either delete or anonymize your information or, if this is not possible (for example, because the information has been stored in backup archives), then we will securely store your information and isolate it from any further use until deletion is possible. Unless we determine it is no longer necessary, we retain your information for as long as your account is active and a reasonable period thereafter in case you decide to re-activate the Services. We also retain some of your information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations, and to continue to develop and improve our Services.
